FRENCH FLOWERS: THE COUNCIL OF STATE DEFINITELY LIFTS THE BAN ON THE SALE OF CBD IN ALL ITS FORMS
Even if we do not sell flowers at Marie Jeanne CBD, we all support the sector.
So this is very good news to start the year 2023 in a relaxed state: following a decision by the FRENCH Council of State on the last Wednesday of December 2022, the ban on the sale in the raw state of the flowers and leaves of certain varieties of cannabis is officially withdrawn.
This decision cancels the decree of December 30, 2021 prohibiting the sale of cannabis flowers and leaves with a THC level of less than 0.3%.
The FRENCH Council of State notably notes several important statements:
- “points out that CBD (cannabidiol), which does not have a psychotropic effect and does not cause addiction, cannot be considered a narcotic product”
- “retains that it has not been established that the consumption of the flowers and leaves of these varieties of cannabis with a low level of THC would entail risks for public health. It therefore considers illegal the general and absolute prohibition of their marketing "
- "CBD has decontracting and relaxing properties and anticonvulsant effects, but does not have a psychotropic effect and does not cause addiction, unlike THC"
- "The harmfulness of other molecules present in cannabis flowers and leaves, in particular CBD, has not been established"
- "could be controlled by means of rapid tests" (to counter the argument that law enforcement cannot recognize a THC-free plant and a THC plant when checked).
So this is good news that announces a good start to 2023 for the small world of CBD.
